Terms of Service

All services provided by Daichi ("Daichi Hosting") may only be used for legal purposes. The transmission, storage or presentation of any information, data or material that violates any federal, state or municipal law of the United States and Canada is prohibited. This includes, but is not limited to: material protected by copyright, material that we consider threatening or obscene, or material protected by trade secrets and other statutes. The subscriber agrees to indemnify and hold Daichi harmless from any claim resulting from the use of the service that damages the subscriber or any other party.

Sites that promote any illegal activity or present content that may damage Daichi servers, or any other server on the Internet, are prohibited. Links to some materials are also prohibited.

Examples of unacceptable content or links:

Hacker programs or files
Warez Sites


Sending unsolicited massive and / or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes towards Daichi, but also because it can overload the Daichi network and disrupt service to Daichi subscribers. Also, keeping an open SMTP relay is prohibited. When a complaint is received, Daichi will investigate and close the account that is sending SPAM. A fee of $ 250 will be charged for violating this policy to the person who initiates the SPAM. In addition, Daichi reserves the right to initiate legal action for this violation.

Server abuse
Any attempt to undermine or cause damage to a Daichi server or client is strictly prohibited. As our customer, you are responsible for all your accounts. If you violate the Terms of Service described in this document, your account will be terminated without the possibility of a refund.

Denial of service
We reserve the right to refuse, cancel or suspend service, in our sole discretion if you conduct denial of service attacks.

All Daichi subnets, distributive hosting sites and dedicated servers must comply with the above policies, with the exception of system resources with respect to game servers.

For the account activation date of each month, Daichi must:

(1) debit the customer's credit card (when such information has been provided by the customer); or

(2) deliver, by email or ordinary mail, an invoice in accordance with the applicable Service Rates for the services provided for the current month. When an invoice is delivered to the customer, the payment will be remitted to Daichi no later than the specified payment due date. Daichi will have the right to immediately terminate this agreement if the client does not make payments on time. An invoice will be provided to you on a monthly basis. All credit cards are billed automatically on a monthly basis. It is the customer's responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, we will send you an email notification, at which time we will need another credit card account number to be provided to us within 24 hours. If we do not receive a response within 24 hours, the account and all accounts under that account plan will be suspended.

3 day trial
Daichi offers a 3-day trial of some of our services, except domains. The service is subject to evaluation in some cases. It is also subject to availability according to available stock, Daichi reserves the right to cancel this offer at any time.

Suspension of service
A service is suspended the next day the contracted plan is finished, after 2 days of suspension to reactivate the service, a small amount will be charged to your bill.

End of a service
When a suspended service reaches the seventh day after being suspended, it will be considered as finished and all the information on the service will be deleted. If a service is terminated there is no way to reactivate this service as all the information has been removed.

If you are not 100% satisfied with your purchase, within 30 days from the purchase date, we will fully refund the cost of your order.

Limitation of liability
In the case of servers located in USA, Daichi will not be responsible for any damages claimed, including incidental and consequential damages, that may arise from Daichi servers being disconnected or unavailable for any reason as they are low-cost servers. the service can be saturated or attacked and remain in stand-by. In the case of GAME servers located in CANADA, there should be no problem with the network or hardware, if there is, the customer is entitled to request a full refund of the payment. Furthermore, Daichi will not be liable for any damages claimed, including incidental or consequential damages, resulting from the corruption or removal of any website from one of Daichi's servers. All damages will be limited to immediate termination of service.

Violations of these Acceptable Use Policies should be sent to [email protected], all complaints will be promptly investigated. Failure to comply with any term or condition will be grounds for immediate account deactivation.

Daichi is not responsible for system downtime, failure or loss of data. We cannot be responsible for any estimate of the earnings that a customer would have made if their site was up and running. Certain services provided by Daichi are resold. Therefore, certain equipment, routing, software and programming used by Daichi are not directly owned or written by Daichi. In addition, Daichi is not responsible for the use of our clients' accounts. Failure to comply with the terms or conditions will lead to automatic deactivation of the account in question. We reserve the right to delete any account, without prior notice for any reason and without refund, as deemed appropriate by Daichi.

Account activation
By activating your account with Daichi, you agree to the above policies and disclaimer. By requesting account activation, you must agree to these policies, guidelines, and disclaimer, and a copy of your acceptance is sent along with your activation request to be kept with your account information.

NOTICE: If you sign up for an account and do not adhere to these terms, no refunds will be given. However, we will inform you by email or phone before taking any action to provide you with an opportunity to correct the problem.

Server uptime guarantee
Daichi guarantees 99% uptime of the service (http, ftp, pop, imap, smtp) in all hosting plans. If we do not deliver it within a certain calendar month, your account will be refunded a prorated amount for the duration of the excessive downtime.

Daichi reserves the right to modify any or all of the above policies, guidelines and disclaimer without notice. We also reserve the right to increase prices and make changes to our account plans without notice.
